Webinar Explores New Jersey Post-Consumer Recycled Content Law

ROSEMONT, Ill. (August 23, 2024)—To assist members and housewares suppliers selling product in New Jersey, the International Housewares Association (IHA) is presenting a webinar focusing on the key details of the New Jersey post-consumer recycled (PCR) content law, including background on the legislation, manufacturers and products covered, PCR content requirements, compliance, exemptions/waivers and penalties. The free program, “Decoding the NJ Recycled Content Law: What You Need to Know,” will be held Wednesday, Sept. 4 at 1:00 p.m. CDT.

Sal M. Anderton, vice president and general counsel for New Jersey-based Porzio Government Affairs, will explain the PCR content law as well as provide details on the current status of Extended Producer Responsibility legislation and discuss what that proposal currently includes and what it may look like if and when it is adopted.

On Jan. 18, 2022, New Jersey Governor Phil Murphy signed P.L. 2021, c.391 (N.J.S.A. 13:1E-99.135-157) into law requiring “manufacturers” (as defined in the law) to meet minimum recycled content requirements for regulated plastic, glass and paper containers and packaging products sold or offered for sale in New Jersey beginning on January 18, 2024. The content requirements apply to containers or packaging products including paper and plastic carryout bags, plastic trash bags, glass containers, rigid plastic containers and plastic beverage containers. The law also prohibits the sale of polystyrene loose fill packaging (packing peanuts).

Companies must determine whether their products or containers and bags are regulated under the law, and, if so, they must register as a manufacturer of a regulated product per the terms and timeframes established in the law.
